Water abstraction permit and concession (law 36-15 / basin agencies)

• Legal basis: law 36-15 (dahir 1-16-113, 2016) — any abstraction of surface or groundwater requires an authorisation or a concession from the competent basin agency (ABH). • Organisation: 10 basin agencies nationwide; authorisation (temporary, small scale) or concession (long term, large scale, with contract). • Fees: law 36-15 provides for an abstraction fee and a discharge fee, applied per basin (no national public tariff). • Procedure: for a new borehole or significant abstraction the ABH may organise a public inquiry and assess the technical file before deciding. • Note: volumes, deadlines and tariffs must be confirmed in writing with the local ABH.
