• Two frameworks coexist: ① law 82-21 (self-production) — in principle self-consumption, with surplus injection capped at 20% of annual production; ② law 13-09 (amended by law 40-19, independent producer) — the operator may supply a consumer or a group of consumers connected to the national grid, and the distribution system operator. • Official wording (ANRE 2025 annual report): law 13-09 allows commercialisation of renewable electricity to consumers or groups of consumers, so the direct corporate PPA route is established. • The surplus cap is identical under both frameworks (at most 20% of annual production); THT/HT injection to ONEE, MT injection to the distributor. • Commercial terms are not a matter of legal fact: duration, price, guarantees, network tariffs (TURT/TSS/TURD) and registration require written guidance from the ANRE or the ministry, or legal advice. • See also the record on green electricity purchase and sale routes (from 1 March 2026: TURT 6.85 / TSS 6.81 / TURD 6.07 cDH/kWh).
