Construction and property insurance: mandatory covers and caps

• TRC (all-risks construction) and RCD (ten-year liability) are mandatory since 30 December 2024 for constructions subject to a building permit, including industrial, commercial, office and service uses; basis: law 59-13 (articles 157-1 to 157-25 of the Insurance Code) and arrêtés 3201-24 / 3202-24 (BO 7376). • Who insures: TRC by the project owner (damage to the works plus site third-party liability); RCD by architects, engineers and contractors; obtaining the compliance certificate is conditional on insurance (art. 157-15). • Caps (arrêté 3201-24): damage cover at least the works value (under MAD 500 million), capped at MAD 500 million (aggregate MAD 1,000 million); site third-party liability at least 50% of the value, between MAD 4 million and MAD 40 million. • Other mandatory covers: civil liability insurance for mining title holders (law 33-13 art. 57); work accidents and occupational diseases (AT/MP) under a commercial insurance regime (law 18-12, ACAPS-licensed insurer, not CNSS). • Cross-border (non-admitted) insurance is prohibited: risks located in Morocco must be covered by a locally licensed insurer.
