Environmental impact assessment (EIA): framework and deadlines

• Current framework: law 49-17 (2020) replaced law 12-03 and organises the environmental acceptability decision (DCE) and the environmental declaration under two nomenclatures. • Scope: industrial, mining, energy, water and infrastructure facilities must complete the procedure before siting and start-up (nomenclatures set by decree). • Deadlines: environmental administrative acts linked to investment are subject to the 30-day statutory deadline under law 55-19 (silence means consent beyond it). • Related permits: liquid discharges (law 36-15 / décret 2-04-553), air emissions (law 13-03 / décret 2-09-631) and waste (law 28-00), issued by the basin agencies and the environmental administration. • Providers: studies must be carried out by approved firms on the official list.
